According to a report by Daily Post Nigeria on September 1 2026, a member of President Bola Tinubu’s legal team in the United States has clarified why the Nigerian leader has not faced arrest over longstanding allegations of drug trafficking.

Wole Afolabi, speaking on Channels Television, stated that Tinubu would already have been indicted, arrested and prosecuted if credible evidence existed linking him to drug-related offences in the United States.

Afolabi was responding to questions surrounding a Freedom of Information Act lawsuit filed by American activist Aaron Greenspan. The suit seeks the full release of records held by the US Department of Justice, the Federal Bureau of Investigation and the Drug Enforcement Administration concerning Tinubu and past investigations.

According to the lawyer, US agencies have already released thousands of pages of documents. Authorities are, however, seeking to keep certain portions redacted. Afolabi explained that full disclosure could compromise law enforcement methods, sources and personnel.

He emphasised that Tinubu’s legal team is challenging the unredacted release strictly within the bounds of American law. “It would amount to professional malpractice on our part if we didn’t take advantage of what the law offers,” Afolabi said.

The lawyer rejected suggestions that the legal challenge amounted to an attempt to hide incriminating material. He maintained that the process is governed by established legal standards rather than the demands of any individual requester.

The FOIA case has been ongoing for some time, with successive releases of material already made available. The remaining dispute centres on whether previously redacted sections should be opened fully.

Afolabi’s comments come amid continued public discussion in Nigeria about the allegations and the US legal proceedings. The president’s team continues to insist that the absence of any indictment or prosecution reflects the lack of substantiating evidence.
